INTELLECTUAL PROPERTY RIGHTS ISSUES IN CYBERSPACE: AN ANALYSIS OF LEGAL CHALLENGES AND REFORMS IN THE DIGITAL AGE

  • The expansion of cyberspace has transformed communication, commerce, and innovation, but it has also created serious challenges for the protection of intellectual property rights (IPR). The digital environment enables rapid copying, modification, and global distribution of content, often without authorization from the rightful owner. This paper examines major intellectual property issues in cyberspace, including copyright infringement, software piracy, trademark violations, and domain name disputes such as cybersquatting. It further analyses the limitations of existing legal frameworks in India, particularly the Information Technology Act, 2000, the Copyright Act, 1957, and the Trade Marks Act, 1999, alongside relevant provisions of the TRIPS Agreement and international conventions. The study highlights jurisdictional difficulties and enforcement challenges in a borderless digital environment. It argues that traditional legal mechanisms are insufficient to address emerging cyber threats. The paper concludes by recommending the need for specialized cyber-IP legislation, stronger enforcement mechanisms, international cooperation, and technological solutions to ensure effective protection of intellectual property in the digital age.
